Frequently Asked Questions

What is an Sexual Harm Prevention Order?

A Sexual Harm Prevent Order, or "SHPO", is a civil order which was known as a Sexual Offences Prevention Order, or "SOPO" prior to March 2015.

What is included in an SHPO or SOPO?

Orders are tailored to the specifics of the offence(s), but they will often include a requirement not to have any contact with a child under the age of 18 years, or that such contact must be supervised, and/or use of the Internet and social media can also be heavily restricted.  Whatever conditions are imposed, they must be justifiable and proportionate to the offences.

When does my SHPO or SOPO end?

Again, this is specific to your order.  After the period of the order comes to an end, it becomes spent.

Can my SHPO or SOPO be changed or discharged?

Yes it can, at any time, by making an on notice, written application to the Court which made the original order.  If the application is being made within 5 years of the order being made, any changes require the permission of the local Chief Constable.

Can I get legal aid to change/discharge my SHPO/SOPO?

The application may be covered under the terms of the original legal aid order.  Paul J Watson Solicitor's specialist Solicitors undertake these applications under both the legal aid scheme and private funding.

How much does it cost to change/discharge my SHPO/SOPO?

We would need to discuss the specifics of your case with you, as legal aid could be available.  Call us on 01642 293427 or send a website enquiry using our contact form, and our Solicitors will call you at a time convenient to you, to discuss this sensitive matter.
